Terms of Service for FreeMute

1. Acceptance of Terms
By downloading, installing, or using FreeMute ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
FreeMute is a mobile application that allows you to control your Android TV's mute function using: - Clap detection - Whistle detection - Volume normalization - Manual remote control
3. License Grant
3.1 Free License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
3.2 Premium License
Premium features require an in-app purchase. Premium licenses are: - Non-refundable (except as required by law) - Non-transferable between devices or accounts - Valid for the specified duration (one-time purchase or lifetime)
3.3 License Restrictions
You may NOT: - ❌ Reverse engineer, decompile, or disassemble the App - ❌ Use the App for commercial purposes without written permission - ❌ Share, sell, or transfer your license to others - ❌ Remove or modify any proprietary notices - ❌ Use the App to violate any laws or regulations
4. Account and Device
4.1 Device Limit
Each license is tied to a unique device identifier. Premium licenses may have device limits as specified in the pricing page.
4.2 Device Transfer
If you change devices, use the "Restore Purchases" feature to transfer your license. Contact support if you experience issues.
5. Purchases and Payments
5.1 In-App Purchases
- Purchases are processed through the Apple App Store or Google Play Store
- Prices are displayed in your local currency
- All sales are final (non-refundable) except as required by law
5.2 Promo Codes
- Promotional codes (LTD codes) are single-use only
- Codes may have expiration dates
- We reserve the right to revoke fraudulently obtained codes
5.3 Refunds
Refunds are handled according to Apple's and Google's refund policies. We do not process refunds directly. Contact the respective app store for refund requests.
6. User Conduct
You agree to: - ✅ Use the App responsibly and legally - ✅ Respect other users and our staff - ✅ Protect your device and license credentials - ✅ Use the App only with TVs you own or have permission to control
You agree NOT to: - ❌ Abuse, exploit, or overload our license validation servers - ❌ Share license codes publicly or with unauthorized users - ❌ Use the App to harass others or damage property - ❌ Attempt to circumvent license restrictions
7. Compatibility
7.1 Device Requirements
FreeMute requires: - Android 5.0+ or iOS 12.0+ - Microphone access for clap/whistle detection - Network access for TV discovery and control - Any Android Smart TV (Android TV / Google TV) — works on all, and especially well on Philips
7.2 No Warranty of Compatibility
We do not guarantee compatibility with all TV models. Use the free version to test compatibility before purchasing premium features.
8. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to: - Local processing of microphone audio (not recorded or transmitted) - Storage of TV configurations on your device - License validation with our secure servers

9. Intellectual Property
9.1 Ownership
FreeMute, including all code, designs, trademarks, and content, is owned by us and protected by international copyright and trademark laws.
9.2 Trademarks
"FreeMute" and the FreeMute logo are trademarks. You may not use our trademarks without written permission.
10. Third-Party Services
10.1 TV Control
The App interfaces with your Android TV using local network protocols. We are not responsible for: - Damage to your TV caused by improper use - TV manufacturer warranties - TV firmware updates that break compatibility
10.2 App Stores

11. Limitations of Liability
11.1 Disclaimer
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: - Indirect, incidental, or consequential damages - Loss of data, revenue, or profits - Damages exceeding the amount you paid for the App - TV damage or malfunction
11.3 Jurisdictional Limitations
Some jurisdictions do not allow limitations on warranties or liability. In such cases, these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless FreeMute, its developers, and affiliates from any claims, damages, or expenses arising from: - Your use or misuse of the App - Your violation of these Terms - Your violation of any third-party rights
13. Termination
13.1 By You
You may stop using the App at any time by uninstalling it. Uninstalling does not entitle you to a refund.
13.2 By Us
We may suspend or terminate your license if you: - Violate these Terms - Engage in fraudulent activity - Abuse our systems or support staff
13.3 Effect of Termination
Upon termination: - Your license to use the App ends immediately - You must delete all copies of the App - No refunds will be issued (except as required by law)
14. Updates and Modifications
14.1 App Updates
We may release updates to: - Fix bugs and improve performance - Add new features - Maintain compatibility with TV firmware updates
Updates may be automatic or require manual download.
14.2 Terms Updates
We may modify these Terms at any time. Changes will be: - Posted within the App with a new "Last Updated" date - Effective immediately upon posting - Notified to users via in-app message
Continued use after changes constitutes acceptance of the new Terms.
15. Support
15.1 Technical Support

15.2 Limitations
Support does not include: - Setup of your TV or network - Troubleshooting third-party hardware - Customization requests - 24/7 availability
16. Governing Law
These Terms are governed by the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Canada.
17. Dispute Resolution
17.1 Informal Resolution
Before filing a legal claim, you agree to contact us at hello@freemute.com to attempt informal resolution.
17.2 Arbitration
Any unresolved disputes shall be settled by binding arbitration in accordance with Canadian arbitration laws.
17.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class action lawsuits.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FreeMute regarding the App.
